Biden is sworn to protect the constitution, right? If there were any actual threat to it, it has to be the orange one. He fomented an insurrection. Russia clearly helped him by calling in bomb threats during the election. He's flat out stated he wants to suspend the constitution himself!
With the immunities granted by the SC, one can imagine Biden has the authority - nay, THE OBLIGATION! - to do what it takes to protect the constitution.
